To the Worshipful the Court of Pleas and Quarter Sessions
November Term 1849
The petition of Clayborne Allred, Aley Allred and Lovicy Allred
Against
Alexander Gray and wife Mary, Solomon Free and wife Matilda, Elisha Allred,
John Allred, George Russel and wife Rebecca, Sarah Free, Jeremiah Elliott
and wife Mary, John Carter, Nicholas Carter, David Carter, Hannah Carter and
Franklin Carter, Children of Jane Carter deceased, Clark Dougan and Wiliam
Dougan Children of Lovicy Dougan deceased: Heirs at law of John Allred, Sr.
deceased
Your petitioners would show unto your Worships that in the year 1849 the
said John Allred Sr., departed this life intestate leaving your petitioners
and said defendants his children and heirs at law, that the said John Allred
Sr. did seized and possessed of a tract of land in said count, situate on
the waters of Deep River adjoining the lands of Elisha Allred, John Allred
Jr., and others, which land by the death and intestacy of the said John
Allred have descended to your petitioners and said defendants as tenants in
common.
Your petitioners do therefore pray that worships will duly consider the
premises and appoint five commissioners unconnected with the parties to
divide and appropriate said land between and among your petitioners and said
defandants share and share alike and if it should be inpractible to make an
equal division, that they charge the more valuable dividinds with each sum
or sums of money as shall make the dividions equal and equitable.
And your petitioners would further represent that they and the defendants
are all of age exept Franklin Carter, whom your worship wil have represented
by Guardian in this suit.
Your petitioners would further show unto your Worships that the defendants
Jeremiah Elliott and wife Mary, George Russell and wife Rebecca and Sarah
Free are not inhabitants of the State, they therefore pray your worships to
make an order of the court directing publication to be made in the North
Carolina Herald published in the town of Asheboro for six succecitive weeks
for said non residing defendants to appear at the next term of this court to
answer or demur to this petition or judgement for consessions will be taken
against them.
Your petitioners do further pray that from time to time your worships wil
make such other and further orders and decrees and grant such other and
furth relief in the premises as to justice and equity may appertain.
And your petitioners as in duty bound will ever pray JC.
